Chapter 28 Continued: Fire Prevention and Building Code Administration

§ 28-9. Stop-work orders.A. The Code Enforcement Official may order any construction under a permit to stop where there exists a violation of plans, specifications or applicable laws or an unsafe or unsanitary condition at the construction site.

B. A stop-work order shall be effective immediately upon personal

service on any owner or agent named on the application for permit or on the second day after delivery by certified mail, return receipt requested, to the address set forth on the application.

§ 28-10. Revocation of permit.

A permit may be revoked by the Code Enforcement Official where:

A. There exists a false statement or misrepresentation of a material fact on the application or accompanying material.

B. The permit was issued in error under applicable law.

C. Construction does not comply with applicable laws.

D. There is a failure or refusal to comply with a stop-work order.

§ 28-11. Right of entry.

Issuance of a permit shall give the Code Enforcement Official or designated agent the right to enter the construction site an-or buildings on the site to inspect and compliance with applicable law.

§ 28-12. Certificate of occupancy.

A. It shall be unlawful for any person, firm or corporation to use or occupy any building or structure or portion thereof in violation of any provision of the Uniform Code or to use or occupy any building, structure or part thereof in a manner inconsistent with the terms of the current certificate of occupancy authorizing such use.

B. In order to ensure that all work authorized by a building permit complies with the conditions of the permit and the Uniform Code and this chapter and the Village Codes, the Code Enforcement Official shall conduct a final inspection of premises before issuing a certificate of occupancy.

C. Ace of certificate of occupancy. A certificate of occupancy is required for any of the following;

(1) Occupancy and use of a building erected, altered, moved or extended or upon which work has been performed which requires a building permit

(2) Change in use of an existing building, as defined in Part 701 of the Uniform Code.

(3) Conversion of any premises for use as an off-street parking area.

D. Conditional certificate of occupancy. Where construction under a building permit is substantially complete and the building may be occupied without endangering the health, safety an-or security of any person or persons, the Code Enforcement Official may, upon written request, grant a conditional certificate of occupancy which shall be valid for a period not exceeding sixty (60) days. After November 1 in any year, a conditional certificate of occupancy may also be granted, upon written request, for a period not to extend beyond June 1 of the following year, to permit completion of all work considered seasonal in nature.

28-13. Certificate of compliance.

A. A certificate of compliance shall be required as follows:

(1) Any installation of equipment in any building other than a one- or two-family dwelling.

(2) Installation of any solid fuel burning appliance in any building before routine operation of said equipment

(3) Any construction affecting the material structure of a building where a certificate of occupancy is not required.

B. No certificate of compliance shall be issued without prior inspection and approval by the Code Enforcement Official.

§ 28-14. Designation of fire limits.

Any area designated on the Zoning Map now in effect as C-1, C-2, C-3 or M, or as said map is hereafter amended, shall be within fire limits and subject to the standards for the areas within Fire limits B as established in the Uniform Code. A building of which more than one-third (1/3) of its area is within fire limits shall be deemed to be located within the fire limits.

§ 28-15. Smoke detector

A. Any dwelling unit not owner-occupied shall contain at least one (1) single-station smoke-detecting device, installed at the expense of the owner. Installation shall be in conformity with the Uniform Code.

B. In a multiple dwelling, at least one (1) single-station smoke-detecting device shall be installed at the expense of the owner, in conformity with the Uniform Code. It shall be provided in sleeping rooms for transient occupancy or within dwelling units adjacent to sleeping spaces and located on or near the ceiling.

C. All buildings located within fire limits shall provide a fire alarm or smoke-detecting system installed in conformity with the Uniform Code.

D. Any smoking device or alarm system shall include therein a test system designed to facilitate a ready determination of operability.

§ 28-16. Property maintenance.

All premises located within the village, whether improved or unimproved, vacant or occupied, shall be maintained in such manner as to assist in protecting the health, safety and general welfare of all persons within the village.

A. All fences installed on premises shall be maintained by the property owner. No fence shall be allowed to fall into a state of disrepair or near collapse so as to constitute a hazard.

B. All planted areas shall be maintained by the property owner in such condition as to prevent the accumulation of overgrown shrubs or trees, which, because of age, accident or neglect, develop conditions which may constitute a hazard to public safety.

C. All lawns shall be maintained by the property owner. Any lawn area or any unimproved lot area where the grass is permitted to grow higher than six (6) inches above ground level shall be presumed to constitute a hazard to public health as an attraction to rodents, vermin and insects.

D. All graffiti or defacement shall be removed from a building or part thereof within five (5) days after receipt by the owner of written notice to remove, issued by the Code Enforcement Official.

§ 28-17. Fees.

The fee for a permit and/or certificate shall be payable upon application, and the amount thereof shall be established by resolution of the Board of Trustees.
